What are border area restrictions for foreign buyers

Properties located within 150 kilometers of Brazil's land borders with neighboring countries are subject to additional restrictions under Law 6.634/1979 and national security legislation. Foreign individuals and legal entities may need prior approval from the National Defense Council (Conselho de Defesa Nacional) to acquire property in these zones — a process distinct from normal urban purchase procedures.
150-kilometer rule
Most international buyers purchase in coastal and metropolitan markets — Florianópolis, São Paulo, Rio de Janeiro, Curitiba — where border restrictions do not apply. However, buyers considering properties in southern border states (Rio Grande do Sul, Paraná), western Mato Grosso, or northern frontier regions must verify geographic coordinates relative to the restricted zone early in due diligence.

Your lawyer confirms geographic eligibility as part of title verification and contract negotiation before execution, preventing contractual commitment to assets that foreign buyers cannot legally acquire without approval — or at all, depending on location and buyer profile.
